Access to Information

Act on the Right of Access to Information (Official Gazette 25/13, 85/15, 69/22)

The right of access to information includes the right of users to request and obtain information, as well as the obligation of public authorities to provide access to requested information or to publish information independently of a request when such publication is required by law or other regulations.

Reuse of information means the use of information held by public authorities by natural or legal persons for commercial or non-commercial purposes different from the original purpose for which the information was created.

Request

• Users exercise the right of access to information by submitting an oral or written request to the :contentReference[oaicite:0]{index=0}.
• If the request is submitted orally or by telephone, an official note will be prepared, and if submitted through electronic communication, it shall be considered a written request.
• A written request must contain the name and registered office of the public authority to which the request is submitted, information relevant for identifying the requested information, the full name and address of the individual applicant, or the name and registered office of the legal entity.
• The applicant is not required to state the reasons for requesting access to information, nor to refer to the application of the Act.

Fees for Access to Information

• No administrative or court fees are charged for access to information in proceedings before public authorities.
• The public authority has the right to request reimbursement of actual material costs incurred in providing the information, as well as delivery costs for the requested information.

Reuse of Information

• Every user has the right to reuse information for commercial or non-commercial purposes in accordance with the provisions of the Act.
• For the purpose of reuse, public authorities are not obliged to create, adapt, or extract parts of information if doing so would require a disproportionate expenditure of time or resources.

In accordance with Article 25 of the Act on the Right of Access to Information, an appeal against a decision of a public authority may be submitted to the Information Commissioner within 15 days from the date of delivery of the decision. A complaint regarding the work of a public authority may also be submitted to the Commissioner.
